NPR's Peter Kenyon reports that Senate Republican leaders have withdrawn a product liability bill that was being blocked by Democrats. The measure would have limited the liability of wholesalers and retailers of products that cause harm. It also would have limited punitive damages against companies with fewer than 25 employees or with annual revenues of less than five million dollars. The measure, which has been debated in various forms for years, was opposed by trial lawyers and consumer group

Causation

Definition:
If you find that the product is defective because it failed to provide a warning when one was reasonably required or because the warning was inadequate, then you will go on to consider the element of causation.

Negligence

Definition:
Negligence occurs when someone breaches some sort of duty to another person, causing some kind of injury to that person.

Strict Products Liability

Definition:
The legal liability of manufacturers and sellers to compensate buyers, users, and bystanders for damages or injuries suffered because of defects in good purchase or a tort which makes the manufacturer or seller liable if the product has a defective condition that makes it unreasonably dangerous.
